With the implementation of the Temporary Protection Directive, we are witnessing a dangerous differentiation of treatment among people fleeing the same war and experiencing the same traumas. The inclusion and exclusion from temporary protection seems to depend on the regularity and level of stability of the claimant’s position in Ukraine, something that can hardly be accepted under international refugee law, which requires protection to be provided without discrimination.
