The present comment tackles the issue of quantifying damages for infringements of image rights. Taking inspiration from a decision of the First Instance Court of Catania, although going well beyond that, this case note starts with an overview of the notion and remedies applied within the field of imagerights, paying particular attention to their gradual monetization and propertisation.Thenwewill draw attention to the functional equivalences and convergences between the remedies adopted to protect image rights and those deployed in trademark law for well-known and unregistered marks. In this sense, the objective is to give a dogmatically feasible explanation for the tendency inferable from Italian case law to move towards punitive damages or restitution in cases which involve image rights like the one under examination. Finally, we will try to extend the analysis to all cases where image rights are associated with marks gifted with advertising and distinctive value, such as in the case of the sole trader who uses his name to identify the enterprise.
Il contributo affronta il tema del risarcimento del danno da abuso dell’immagine altrui e da violazione dell’esclusiva sul ritratto. Prendendo spunto da una recente decisione del Tribunale di Catania, sia pure andando oltre i fatti di causa, si cerca di analizzare l’evoluzione della tutela dei diritti all’immagine, ponendo l’accento sulla loro progressiva patrimonializzazione e proprietarizzazione. Il lavoro dà rilievo alle equivalenze funzionali ed alle convergenze rimediali fra tutela autorale del ritratto e tutela del marchio notorio, al fine di dare una spiegazione più coerente alla curvatura deterrente e pararestitutoria assunta dai rimedi risarcitori in questo ambito. Infine, si cercherà di estendere tali considerazioni a tutti i nomi ed i ritratti dotati di capacità distintiva e pubblicitaria, trattando il caso della ditta individuale, altresì oggetto della controversia in esame.
